DEFINITIONS
MADE IN AFRICA TOURS AND SAFARIS CC CK 2006 028071/23 is hereinafter referred to as “MADE IN AFRICA TOURS AND SAFARIS” (“the Company”).
The person, or persons, named on the booking confirmation is hereinafter referred to as the “Client”.
The agreement between the Client and the Company is deemed to have been concluded in the Republic of South Africa and shall be governed by and construed in accordance with the laws of the Republic of South Africa.
BOOKING AND CONFIRMATION
All safaris are individually designed itineraries and are subject to availability at the time of reservation.
A booking shall only be considered confirmed once:
1. A written confirmation invoice has been issued by the Company; and
2. The required deposit has been received.
The Company reserves the right to release any provisional reservation without prior notice should the required deposit not be received within the stipulated timeframes.
The balance of the total safari cost is payable no later than six (6) weeks prior to the commencement date, unless otherwise specified in writing.
DEPOSITS AND PAYMENTS
A non-refundable deposit of 30% of the total safari cost is required to secure all reservations.
Certain properties, charter operators, or peak season bookings may require higher deposits or full prepayment. The Client will be advised accordingly at the time of booking.
All payments shall be made free of bank charges and in the currency specified on the invoice.
CANCELLATIONS AND AMENDMENTS
All cancellations or amendments must be submitted in writing and shall only be effective upon written acknowledgement by the Company.
The following cancellation fees shall apply:
– More than 90 days prior to departure: loss of deposit
– 89 – 60 days prior: 50% of total safari cost
– 59 – 30 days prior: 75% of total safari cost
– 30 days or less prior: 100% of total safari cost
Certain lodges, camps, and air operators in Southern Africa may apply stricter cancellation terms. In such cases, the stricter terms shall take precedence and will be communicated at the time of booking.
No refunds shall be provided for no-shows, late arrivals, or early departures.
REFUNDS
No refunds shall be made for any unused portion of the safari, including but not limited to accommodation, flights, activities, or services.
In the unlikely event that the Company is required to cancel a safari prior to commencement, all monies received will be refunded in full. Such refund shall constitute the full extent of the Company’s liability.
SAFARI OPERATIONS AND THIRD-PARTY SUPPLIERS
The Company acts as an intermediary in securing services with independent suppliers, including but not limited to safari lodges, camps, charter airlines, road transfer providers, and guides throughout Southern Africa (including Botswana, Namibia, South Africa, Zambia, and Zimbabwe).
While every effort is made to ensure the highest standards, the Company shall not be liable for any act, omission, default, or negligence of such suppliers.
The Client agrees to comply with all operational requirements and safety instructions issued by any supplier, including lodge management, guides, and aviation personnel.
LIGHT AIRCRAFT AND BAGGAGE RESTRICTIONS
Due to the remote nature of many Southern African safari destinations, transportation between camps is frequently conducted by light aircraft.
Strict luggage restrictions apply:
– Maximum of one soft-sided bag per person
– Maximum combined weight of 20 kilograms (including hand luggage and photographic equipment)
The use of hard-shell suitcases is not permitted.
The Company and/or the relevant air operator reserves the right to refuse carriage of excess or non-compliant baggage.
The Client acknowledges that luggage may be transported on separate aircraft for operational reasons.
TRAVEL DOCUMENTATION AND ENTRY REQUIREMENTS
The Client is solely responsible for ensuring that all passports, visas, vaccination certificates, and other travel documentation are valid and comply with the entry requirements of each country visited.
Passports must be valid for a minimum of six (6) months beyond the date of return travel and must contain sufficient blank pages.
The Company shall not be held liable for any costs incurred as a result of the Client failing to comply with immigration or health requirements.
INSURANCE
Comprehensive travel insurance is a condition of booking and must be in place prior to travel.
Such insurance must include, at minimum:
– Emergency medical expenses
– Medical evacuation (including air evacuation)
– Trip cancellation and interruption
– Loss or damage to personal belongings
Failure to obtain adequate insurance shall be at the Client’s sole risk.
FORCE MAJEURE
The Company shall not be liable for any failure or delay in the performance of its obligations where such failure is due to events beyond its reasonable control.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, the Company shall not be liable for any loss, damage, injury, or death arising directly or indirectly from participation in any safari or associated activity.
The Client indemnifies and holds harmless the Company.
CONDUCT
The Company reserves the right to withdraw services without refund should the Client’s behaviour endanger safety or disrupt the safari.
PHOTOGRAPHY AND MEDIA
The Company reserves the right to use any photographs or video material taken during the safari for marketing purposes unless otherwise requested.
HEALTH AND FITNESS
The Client warrants that they are medically fit to undertake the safari.
ANNEXURE A: CHARTER FLIGHT CONDITIONS
1. GENERAL
Charter and scheduled light aircraft flights form an integral part of many fly-in safaris across Southern Africa.
2. AIRCRAFT TYPES AND ROUTING
Flights may involve multiple stops and routing changes.
3. LUGGAGE RESTRICTIONS
Maximum of 20kg per person in soft bags.
4. PASSENGER WEIGHTS AND SEATING
Passengers may be required to provide accurate weights.
5. TIMINGS AND DELAYS
Schedules are subject to change.
6. WEATHER AND OPERATING CONDITIONS
Flights operate subject to weather and safety conditions.
7. SAFETY AND COMPLIANCE
Passengers must comply with all safety instructions.
8. DANGEROUS GOODS
Restricted items are not permitted onboard.
9. INSURANCE
Appropriate insurance is required.
10. LIMITATION OF LIABILITY
The Company is not liable for third-party air operators.
